REGULATION OF ONLINE SALES OF WORKS OF ART
I. Types and scope of online services
1. This regulation specifies the principles of sale of works of art and protection of personal data by Latająca Galeria.
2. Latająca Galeria is a web-based gallery, operating at www.latajacagaleria.com, run by Clotilde Simonis-Gorska with registered office in Warsaw (01-066), at ul. Burakowska 9, entered into the register of economic activity maintained by the President of the Capital City of Warsaw under number 359612, holder of a tax identification number NIP 526-269-04-51.
3. At www.latajacagaleria.com Latająca Galeria conducts sales of works of art via Internet.
II. Terms and conditions of electronic services provision
1. The technical requirements necessary to support the IT system used by Latająca Galeria are as follows:
- Internet browser: Microsoft Internet Explorer 6.0 or newer, Mozilla Firefox 2.0, Opera 9.0
- Support of cookies enabled
- Support of Javascript enabled
- Active e-mail account (with the possibility to receive e-mails).
2. The customer is prohibited from submitting contents of illegal nature.
III. Terms and conditions of concluding and terminating contracts for provision of electronic services
1. Orders are accepted via the website: www.latajacagaleria.com .
2. Upon placing the order, the customer shall receive a confirmation by e-mail to confirm that the order was received by Latająca Galeria.
3. The order is sent for processing at the moment the customer submits the order and makes the payment at the account of Latająca Galeria.
4. The moment when the Buyer submits the order on the gallery's website is the moment of conclusion of a contract between the Seller and the Buyer.
5. For the order to be proceeded, it is necessary for the Buyer to fill in the registration form with necessary details.
6. Submission of the order by the Buyer is equal to acceptance of the regulation.
7. For each order, a VAT/MARGIN invoice is issued.
8. The Buyer may withdraw the order submitted before its despatch.
The abovementioned changes can be made upon contacting Latająca Galeria: by e-mail galeria@latajacagaleria.pl or by phone.
9. If the Buyer fails to contact Latająca Galeria and pay for the order submitted, Latająca Galeria shall cancel the order after 10 days from its submission. Further, the cancelled order shall have no legal effects.
10. The quoted prices are gross prices and inclusive of VAT/MARGIN tax.
11. The price quoted at every work of art is binding for the moment of submission of the order by the customer. Latająca Galeria reserves the right to change the prices of works of art at the Gallery.
12. The customer shall cover the costs of freight. The delivery of the work of art takes place as selected by the customer and as specified in the order.
13. Delivery times:
- domestic freight: 5 days (subject that if the ordered work of art is not available at the Gallery's warehouse at the moment of order submission, the execution of the order may take longer, of which the customer will be individually informed by e-mail or by phone).
- international freight: the time of delivery depends on the location and type of transport and shall be agreed on an individual basis by e-mail or by phone.
14. Shipments are delivered by:
- Pocztex - domestic freight,
- TNT - international freight.
15. Latająca Galeria shall not be held liable for any shipping delays.
16. Latająca Galeria shall not be held liable for any damages occurred as a result of transport.
17. Latająca Galeria shall not be held liable for any force majeure events that prevented the execution of the contract.
18. The sales contract is concluded in accordance with the Polish law and in the Polish language.
19. The artist retains full copyrights to the work of art sold. The artist and Latająca Galeria retain the rights to copy and publish the work of art sold. The buyer has the right to use the purchased work of art only for private purposes.
20. Any disputes shall be settled amicably or if no agreement is reached, by the court specific for the registered office of Latająca Galeria.
IV. Type of complaint procedure
1. The buyer has the right to return the purchased work of art within 10 days from its receipt without giving reasons. The returned work of art must be sent back together with the accompanying invoice. Latająca Galeria guarantees the reimbursement of sum equal to the price of purchase. Money shall be reimbursed within 10 working days by bank transfer to the account indicated by the customer or by postal order to the address indicated in the order. The cost of return of goods shall not be reimbursed.
2. If the customer wishes to place a complaint, the reason for complaint and the customer's expectations concerning the method of complaint settlement must be specified by e-mail or by phone.
3. Within 7 days from the date of notification, Latająca Galeria shall send to the customer an answer to his complaint, and if the complaint is considered as justified, Latająca Galeria shall contact the customer to define the method of compensation.
4. The document of sale constitutes the basis for placing complaint.
V. Personal data processing
1. The personal data of the buyer are protected by the Privacy Policy of the company. Latająca Galeria cares for the security of data made available; the data are duly protected and secured against the access of unauthorised persons.
2. Latająca Galeria processes personal data of the customer necessary to establish, elaborate the content, amend or terminate the legal relation specified in the registration form.
3. When filling in the registration form, the customer consents to the processing of data included therein.
4. After end of use of the service provided online, Latająca Galeria, without the customer's consent, will process only the data which are:
- necessary to settle the service and vindicate claims for payments for use of the service,
- necessary to explain the circumstances of unauthorised use of service,
- permitted for processing on the basis of separate acts or contract.
5. At the customer’s request, Latająca Galeria grants the customer the access to current information about:
- technical means which are made available by the service provider to prevent unauthorised persons from access and modification of personal data sent by electronic means,
- entity whom the service provider entrusts with the data processing, its scope and intended date of submission, if the service provider concluded with this entity a contract on submitting data for processing.
